The following Privacy Policy (Policy) explains how Luminoso may collect, use, and disseminate information obtained from users and visitors (collectively, Users) of the Site. Information Collected
Luminoso collects both Personal Information and Other Information about Users of the Site as described below. For purposes of this Policy, Personal Information is information that Luminoso can directly associate with a specific person without additional information. Other Information is any information that is not Personal Information. Luminoso may combine Personal Information with Other Information, in which case Luminoso will treat the combined information as Personal Information.
Luminoso also may combine Personal Information or Other Information that Luminoso has about you with additional information that Luminoso or third parties collect in other contexts—such as Luminoso’s communications with you via email or phone, or your customer service records. In those circumstances, Luminoso will treat the combined information in accordance with this Policy.
You can visit the Site without submitting any Personal Information. However, as described below, Luminoso automatically collects some Other Information when you visit the Site. Additionally, you may be required to register to gain access to certain Site content. When you do so, Luminoso’s registration process may require you to provide various types of Personal Information, such as your name, username, password, email address, company name, telephone number, and certain additional information. You are not required to provide this information, but if you do not provide it, you may not be able to access certain Site content. Additionally, if you apply for a position with Luminoso through the online application portal, Luminoso collects your resume and other information such as your physical address, contact information, employment history, educational background, personal references and the like.
When you visit the Site, web servers automatically collect Other Information about your visit (such as traffic data like IP addresses, time, date, type of browser, type of operating system, and the address of the website from which you entered the Site), which is stored in server logs. Luminoso also collects more specific information about you and your use of the Site (such as the frequency or duration of your visits). Collecting such data may entail the use of software programs, web beacons, pixel tags, third-party tracking technologies, cookies, or other numeric codes used to identify a computer.
A web beacon or pixel tag is an electronic file that usually consists of a single-pixel image. It can be embedded in a web page or in an email to transmit information, which could include Personal Information. For example, it allows an email sender to determine whether a user has opened a particular email.
“Cookies” are small files that are stored on your computer by your web browser. A cookie allows the Site to recognize whether you have visited before and may store user preferences and other information. If you are concerned about having cookies on your computer, you can set your browser to refuse all cookies or to indicate when a cookie is being set, allowing you to decide whether to accept it. You can also delete cookies from your computer. However, if you choose to block or delete cookies, certain features of the Site may not operate correctly.
Use of Information
Luminoso uses your Personal Information to contact you with information about Luminoso and its products, to respond to your inquiries for additional information, to fulfill your requests, to send you promotional emails and newsletters in a manner consistent with your choices and applicable law, to comply with legal and/or regulatory requirements, and for Luminoso’s other business purposes.
If you submit a job application through the Site, Luminoso may use your Personal Information to review, evaluate, and verify your credentials and experience, and to conduct background checks and create reports about applicants.
Luminoso uses Other Information to help diagnose problems with its web servers, to administer and improve the Site, and to analyze User trends and behaviors. Luminoso may also use Other Information for any other business purpose permitted by law.
Sharing of Information
Luminoso will not share your Personal Information with any third party for commercial purposes that are not related to Luminoso products and services. Luminoso may, however, share your information with third parties for the purposes described below.
Third-party service providers. Luminoso may disclose Personal Information to third-party service providers for technical and customer support and to help Luminoso manage and improve the Site. These service providers may collect and/or use your Personal or Other Information to assist Luminoso in achieving the purposes discussed in this Policy. For example, Luminoso uses third parties to help target and implement Luminoso email communications. Luminoso also uses third-party platforms to help manage relationships with the people and companies that use the Luminoso Site.
Business Partners. Luminoso may share your Personal or Other Information with Luminoso business partners to fulfill your requests for services; complete a transaction that you initiate; or meet the terms of any agreement that you have with Luminoso or our business partners.
Your direct sharing of Personal Information through the Site and third-party websites. The Site may enable you to share Personal Information directly through the Site. For example, the Site includes a blog to which you may post comments. Please ensure when using these features that you do not submit any Personal or Other Information that you do not want to be seen, collected, or used by other users. In addition, the Site may contain links to third-party websites that incorporate comment and social media features, including the Facebook “like” button and the Twitter “follow” button. If you choose to use these features, you may be disclosing your Personal Information not just to those third-party websites and services, but also to their users and the public more generally. Because these third-party websites and services are not operated by Luminoso, Luminoso is not responsible for the content or practices of those websites or services. The collection, use, and disclosure of your Personal and Other Information will be subject to the privacy policies of the third-party websites or services, and not this Policy.
Third-party plugins. The Site integrate certain third-party plug-ins (such as a Facebook “like” button and Twitter “follow” button). Even if you do not click on these plug-ins, they may collect information about you, such as your IP address and the pages that you view. They also may set and/or access a cookie. These plugins are governed by the privacy policy of the company providing them.
Legal purposes. Luminoso may use or share your Personal or Other Information with third parties when Luminoso believes, in its sole discretion, that doing so is necessary: (i) to comply with applicable law or a court order, subpoena, request from government or law enforcement, or other legal process; (ii) to investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of Luminoso’s terms and conditions, or situations involving threats to Luminoso property or the property or physical safety of any person or third party; (iii) to establish, protect, or exercise Luminoso’s legal rights or defend against legal claims; or (iv) to facilitate the financing, securitization, insuring, merger, acquisition, sale, assignment, bankruptcy, or other disposal of all or part of our business or assets.
De-identified or aggregated information. Luminoso also may share de-identified and aggregated information about Site users.
Business Transfers
Luminoso may transfer Personal and Other Information and User content to any successor to all or substantially all of its business or assets that concern the Site. In the event of such a transfer, such successor will have all of the rights and be subject to all of the obligations of this Privacy Policy, including, without limitation, the right to modify or replace this Privacy Policy, as provided herein.
Third-Party Analytics and Targeted Advertising
Luminoso may partner with certain third parties to collect Other Information and to engage in analytics, auditing, research, and reporting. These third parties may use web logs or pixel tags, and they may set and access cookies on your computer or other device. In particular, the Site uses Google Analytics to help collect and analyze certain information for the purposes discussed above. You may opt out of the use of cookies by Google Analytics here.
The Site also may enable third-party tracking mechanisms to collect Other Information over time and across unaffiliated websites for use in online behavioral advertising. For example, third parties may use the fact that you visited the Site to target online ads for Luminoso products and services to you on non-Luminoso websites. In addition, third-party advertising partners might use information about your use of the Site to help target non-Luminoso advertisements based on your online behavior in general. The use of online tracking mechanisms by third parties is subject to those third parties’ own privacy policies, and not this Policy. If you prefer to prevent third parties from setting and accessing cookies on your computer, you may set your browser to block cookies. Additionally, you may remove yourself from the targeted advertising of companies within the Network Advertising Initiative by opting out here, or of companies participating in the Digital Advertising Alliance program by opting out here. The Luminoso Site currently does not respond to “do not track” browser headers.
Security and Retention
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, Luminoso cannot ensure the security of any information you provide, and you do so at your own risk. Once Luminoso receives your transmission, it will make reasonable efforts to ensure its security on Luminoso’s systems.
Luminoso will retain your Personal Information for as long as reasonably necessary to accomplish the purposes in this Policy or as required by law.
Reviewing and Updating Information
If you want to learn more about the Personal Information that Luminoso has about you, or you would like to update or change that information, please contact Luminoso by email at info@luminoso.com. You may access, amend, and/or request deletion of certain information to the extent permitted under applicable law.
If you are a California resident under 18 years of age and a registered user of the Site, you may request that Luminoso remove content and information that you post on the Luminoso Site or blog. To obtain removal of such content and information, please send Luminoso an email to info@luminoso.com with a short description of the content or information you would like to have removed. Please note that such a request does not necessarily ensure complete or comprehensive removal of content posted by you, since the content and information may remain in our databases, may remain visible in a manner that does not identify you, or may have been re-posted by another user.
Opt-Out
If you no longer want to receive marketing communications from Luminoso, please follow the “unsubscribe” instructions that are included at the bottom of each message. Please note that if you unsubscribe from Luminoso marketing communications, you will still receive administrative messages.
Links to Other Websites
The Site contains links to other websites not operated or controlled by Luminoso. If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them, have their own privacy policies. Luminoso is not responsible for the privacy practices of other websites. Luminoso encourages users to be aware when they leave the Site and to read the privacy policies applicable to such third-party websites. This Policy applies solely to the information collected through the Site.
Children
Luminoso does not knowingly collect any Personal or Other Information from any person that is under the age of 13. If Luminoso becomes aware that a person under 13 has provided such information, Luminoso will take steps to remove the information and terminate the respective registration.
Users Outside of the USA
YOUR PERSONAL INFORMATION MAY BE PROCESSED BY LUMINOSO IN THE COUNTRY WHERE IT WAS COLLECTED AND IN THE UNITED STATES. LUMINOSO ALSO MAY SUBCONTRACT THE PROCESSING OF YOUR PERSONAL INFORMATION TO, OR OTHERWISE SHARE YOUR INFORMATION WITH, AFFILIATES OR THIRD PARTIES IN THE UNITED STATES OR COUNTRIES OTHER THAN YOUR COUNTRY OF RESIDENCE. THE DATA-PROTECTION LAWS IN THESE COUNTRIES MAY BE DIFFERENT FROM, AND LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY. BY USING THE SITE, OR PROVIDING INFORMATION TO LUMINOSO, YOU EXPRESSLY CONSENT TO LUMINOSO’S TRANSFER AND PROCESSING OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY.
Changes to Privacy Policy
Technology and the Internet are rapidly changing. Luminoso may change the Site in the future and as a consequence will need to revise this Policy to reflect those changes. Luminoso will use reasonable efforts to notify you of any material change at least 30 days in advance of the effective date of any change. Change notices may be communicated by postings at the Site or by email. In any case, you should periodically check the Privacy Policy for changes. Continued use of the Site following such notice of any change to the Privacy Policy constitutes your acceptance of those changes. Information collected by the Site is subject to the Privacy Policy in effect at the time of use.
